Case Filed against Police for Alleged Torture in Custody
Malda, October 11, 2012: A case was filed against police today for allegedly torturing a youth Mithun Mandal (18) in custody. The said youth was allegedly picked by police on charge of keeping fake currency at night on 22 September from his house.
It was claimed by Mithun’s family that the inmates who tried to resist police allegedly faced only assault. Even the pregnant sister was not spared as well. Claimed as innocent, Mithun Mandal (18), suffered worse at the police custody. He was allegedly severely beaten up which landed him to hospital, referred to Kolkata and admitted to Behrampore on way to Kolkata. His father Sudhir now files a case against police in Malda Court.
In a letter to State Human Rights Commission, Sudhir claimed that at late night on 22 September, police of Baishnabnagar Police Station raided his house and picked his son Mithun. Police claimed that Mithun was involved in smuggling of fake currency although police could recover no fake currency from him. At this Mithun’s pregnant sister Menoka acme to resist police and urge them that Mithun would go to police station next morning. But police in turn assaulted Menoka.
Mithun was produced to Malda Court on 24 September and was taken to police custody. He was allegedly severely tortured by police there and fell ill. On 1 October Mithun was again produced to court and was sent to jail custody then. By then he was already reportedly wounded.
Next day when his father went to meet him in jail, it was claimed to have been said that ailing Mithun was taken to Malda District Hospital. Going there Sudhir found his son unconscious visibly beaten by police. Late that night two policemen came to Sudhir to inform that his son was being taken to Alipur Central Jail. Sudhir was even made to sign a paper unknown to him.
However, queries at Alipur Central Jail did not find Mithun there. When the Association for Protection of Democratic Rights (APDR) team visited Malda Jail again, they were told that Mithun could not be taken to Kolkata; instead following his deteriorating health, he had to be admitted to Behrampore on his way to Kolkata. Goutam Choudhury, Working President of Malda APDR said, “Our men of Behrampore went to meet Mithun. His condition is very serious and he is still unconscious. The police torture was evident.”
Sudhir Mandal filed a case against the police of Baishnabnagar Police Station today for the torture on his son.
However, SP, Malda Jayanta Pal said, “Police have acted lawfully. The allegation of torture in police custody is totally false.”
